Business Associate Agreement

When NuGenera Health handles protected health information (PHI) on behalf of a covered entity, we do so under a Business Associate Agreement (BAA) as required by HIPAA. This page summarizes the purpose of that agreement; the executed BAA between NuGenera Health and each client governs in the event of any conflict.

What the BAA covers

The BAA establishes the permitted and required uses and disclosures of PHI, the safeguards we apply, our obligations regarding subcontractors, and the process for reporting security incidents and breaches.

Permitted uses

We use and disclose PHI only to perform the revenue cycle services described in our services agreement, as required by law, or as otherwise permitted by the BAA.

Safeguards

We agree to implement appropriate administrative, technical, and physical safeguards to protect PHI and to ensure that any subcontractors that receive PHI agree to comparable protections.

Term and return of information

The BAA remains in effect for the duration of our engagement. On termination, we return or destroy PHI where feasible, consistent with the terms of the agreement and applicable law.
